| 摘 要： | 事实推定是司法证明的一种重要的辅助性方法，其在证据证明力所不及的地方发挥着不可替代的作用。作为犯罪故意的特定构成要素，特定明知相对于一般明知，指涉对特定内容的明知。事实推定是解决司法实务中特定明知认定难的有效路径，可以在奸淫幼女罪与赃物罪对特定明知的认定中谨慎适用。

| Abstract: | Fact presumption plays an important role in the area that evidence a not enough,and therefore is an important auxiliary method in judicial proof.Particular knowing as the constituent elements of the criminal intention,particular knowing in relation to general knowing,reference to know the particular contents.Fact presumption is the effective method to solve particular knowing in judicial practice. |
