吴经熊法律哲学思想研究

本文主要研究了吴经熊的法律哲学思想.从总体上讲,可以大致划分为两个阶段即早期阶段与后期成熟阶段.其早期阶段的思想主要由三对矛盾贯穿而成:法律资源论上的本土资源与外来资源之间的矛盾;法律方法论上的经验式观察与理性推理之间的矛盾;法律思想上的理想主义与现实状况之间的矛盾.后期的思想则主要围绕着法律、宗教、哲学三者之间的关系而展开.通过研究作者揭示出了吴氏思想的核心部分:即超越东西方的法律文化.而这样的法律思想将构成对当今法律全球化时代挑战的一种积极的回应.

On Wu Jingxiong's Legal Philosophy

This text mainly studied Wu's law philosophy thought.From total speak up,can be divided into two stages mostly namely the primary stage in early days and the mature stage.His primary thought is made up by three antinomies: The antinomy of the native resources and the foreign resources of the legal resources theory;The antinomy of the experience type observation and reasonableness of the law methodology reason logically;The antinomy of the idealism and realistic condition of the law thought.His late thoughts are mainly made up by law,religion,philosophy.The author find out the central part of the thought: the harmony of surmounting the east and the west.And such law culture then to nowadays can be a aggressive response to the legal globalization ages' challenge.
