转型社会的青少年犯罪控制——以“全国重点青少年群体教育帮助和预防犯罪试点”为例的研究

中央综治委推行的五类重点青少年群体教育帮助与预防犯罪试点工作,体现了青少年社会管理思维的进一步转化,也是试图通过完善重点青少年管理机制、实现对底层群体有效社会管理技巧的展现。但是,这样的控制技巧,也存在标签化、干扰重点青少年群体及其家庭生活,甚至侵害重点青少年群体权益等风险。重点青少年教育帮助与预防犯罪试点的方向应是将以"单位"为载体、强制力为后盾的青少年管理传统模式向以社区为载体、福利为后盾的青少年管理模式转变,尊重青少年的自理性,综合运用情感、成本、精力、道德等多种手段促使重点青少年"融入"社会而非使其"突兀"于社会。

The Juvenile Delinquency Control in Transition Society——A Research Based on Pilot of National Educative Help and Criminal Prevention to Focal Teenage Groups

The pilot of educative help and criminal prevention to five focal teenage groups implemented by Central Committee for Comprehensive Management of Public Security shows the further idea change of social management,and also shows the social management skill to bottom teenage by improving the management system to focal teenage.Nevertheless,this type of control skill also has the risk of stigma,disturbing the family life,or even violating the rights of teenage groups.The pilot tendency of educative help and criminal prevention to focal teenage groups should change from the traditional teenage management model which based on family and coercive force to the model which based on community and welfare.This new model should respect teenage’s self control and use feeling,cost,energy,morality to promote teenage integrating into society instead of disintegrating into society.
