| 摘 要： | WTO争端解决机制是WTO法律规则体系的极为重要的组成部分.与GATT争端解决机制相比较,WTO争端解决机制的"司法化"取向是WTO争端解决机制的最重要的特点之一.GATT争端解决机制的内容的简单化和不规范导致GATT争端解决机制本身存在许多缺陷,不能在贸易争端解决中发挥应有的作用.通过吸收GATT争端解决机制的合理内核并汲取其经验教训,WTO在争端解决机制中增加了许多新的内容,这些内容充分体现了WTO争端解决机制的"司法化"取向.WTO争端解决机制的"司法化"取向对WTO争端解决机制本身的完善及其作用的发挥具有很大的积极意义和推动作用.

| Abstract: | WTO dispute settlement mechanism is a very important part of WTO legal system. To compare it with GATT dispute settlement mechanism, the judicial tropism is one of the most important characteristics of WTO dispute settlement mechanism. The simplification and irregularity of the content of GATT dispute settlement mechanism makes itself for many limitations, and it could not play the more important role in settling disputes than it should. WTO have enhanced a lot of new spirits into the dispute settlement mechanism, by absorbing the reasonable core of GATT dispute settlement mechanism and deriving its experiences ,which materialize the judicial tropism of WTO dispute settlement mechanism. The judicial tropism of WTO dispute settlement mechanism have a great significance and impulsive effect on perfection of WTO dispute settlement mechanism. |
