| 摘 要： | 鉴定结论是我国三大诉讼法所确立的基本证据形式之一。目前 ,由于理论认识上的偏差、体制设计的混乱及制度规定的匮乏 ,致使司法鉴定运作存在不少问题。对此 ,既需要从理论上加以完善 ,又要注重现实条件下的制度改良及其运作。

| Abstract: | appraisal results are one of fundamental proof's forms in three procedural laws of China.At present,owing to theoretical understanding's deviation,system's confusion and lack of system regulations, a lot of problems exist in the judicature appraisal.This article thinks that it is necessary to perfect theoretically and reform system of judicature appraisal under condition of laying stress on reality. |
