刑事证明标准作用原理和规制机制

刑事证明标准在理论界存在争议。很多诉讼法学者希望能够找到具有可操作性的"标准"。从人类语言表述的特点和刑事案件本身形态的多样性来看,可操作的刑事证明标准是不可能存在的。但另一种标准是存在的,通过规制裁判者的内心来达成内心确信,形成一种合理的标准机制。可以说,刑事证明标准最终的解决道路在于授予权力和监督权力的统一,即既在一个独立的审判程序之内授予心证者独立而自由的心证权力,又通过另一个独立的诉讼程序来监督心证者的裁判,同时,对有过错的心证裁判予以依法惩处。

There is dispute on criminal standard of proof among theoretical circles.Many procedural scholars hope to find a workable ＂standard＂,but has not found yet.Taking the features of human language and the diversity of the criminal cases into account,the criminal standard of proof that is operable does not exist.However,another standard exists,by regulating the arbiter＇s inner to reach the heart sure and then form a reasonable standard mechanism.It can be said that the ultimate solution of the criminal standard of proof is the unity of authority and supervisory powers,that is,not only granted the inner conviction power in a separate proceedings,but also adopt a separate procedure to monitor the inner convictions.Of course the referees of fault inner convictions shall be punished according to the law.
