| 摘 要： | 口承法形态下的各民族都会在自己独特的文化背景下设定诉讼程序和解决纠纷的方法,以在我国西南地区苗族村落中至今还能看到这种原生态诉讼文化的影子,很有典型性.苗族传统的诉讼文化中纠纷解决是通过理师的"摆古说理"来完成的.理师在厘清诉讼双方的具体责任和过错时以"筹"作为计算工具.纠纷裁定过程是以口头传承下来的"古理"和"先例"为法的依据,并形成了口传的"理词",使习惯法内容得以具体化、固定化.有些内容被编成"古歌",使法的传播范围更广.

| Abstract: | All nationalities with oral legal culture have developed lawsuit procedures and ways to resolve disputes in light of their unique cultural background.The primitive lawsuit culture is still well preserved in some of the villages in the southwest region of China.In the traditional oral legal culture,disputes are resolved by a lishi who refers to precedents for legal principles or rules.A lishi usually uses "chou",or tally,to measure the responsibilities of the defendant and the plaintiff.Disputes are resolved... |
