| 摘 要： | 形成于上世纪60年代的保理在短短半个世纪里以十分迅猛的速度飞速发展,在发达国家,已经超过了信用证等传统结算工具的使用比例,国际统一私法协会起草了《国际保理公约》来减少保理业务的国际化中产生的冲突。作为目前最大的保理业组织———国际保理商联合会(FCI),也制定了《国际保理业务惯例规则》和《仲裁规则》来促进国际贸易的发展。目前联合国国际贸易法委员会拟定的《国际贸易中的应收帐款转让公约》也已经通过。这一切正向我们预示着,国际保理正在全球蔓延开来。作为贸易大国的中国,更应该吸收采纳这种金融服务产品。然而我国保理正处于起步阶段,为了推动我国保理的发展,了解国内发展的现状,建构我国的法律框架日益凸显重要性。

| Abstract: | The system of factoring develops fast since its coming into being in 1960s and it is utilized more than letter of credit and the International Factoring Convention is drafted to decrease the conflicts in international factoring.The FCI schemes the the Rule for International Factoring and Arbitration Rule to promote the international trade.That presents the development of factoring and prepels China to adopt the new financial service.Thus,learning the present situation of factoring in China is significant for promoting its development and construct the law frame of it. |
