基于主权发展图示的行政行为行动逻辑

从行政学视角来分析,本质上,主权起源于社会治理。从学理上看,共同体设置主权者主要是为了提供和维护公共产品。主权和主权者是两个历时性的概念。从农业社会到工业社会再发展到后工业化,主权的属性将从私人属性逐渐回归其本质的公共属性,主权者也从私有属性的主体转化为公共属性的主体。行政行为的行动逻辑是行政责任结构形成、责任链条传递和责任实现的逻辑。在社会治理体系的发展过程中,行政行为的责任结构从农业社会以秩序为主导发展到工业社会以效率为主导,并在后工业社会的合作共同体中形成以公平为主导的责任结构。

On the Logic of Administrative Action Based on Sovereignty

Sovereignty stems from social governance.The establishment sovereignty is to provide and maintain the social goods.From agricultural society to industrial society and then to post-industrial society,the property of sovereignties will return from the personal property to the public property,and the sovereign will also change from the subject with personal property to the party involving public interest,a subject with public property.The logic of administrative action based on sovereignty is a process which forms,transfers and realizes the structure of administrative responsibility.In an agricultural society,the administrative responsibility is mainly to establish the social order;in an industrial society,it is mainly to promote the administrative efficiency;in a post-industrial society,it is mainly to ensure the social justice.
