刑事诉讼分权制衡机制之价值论析

分权制衡机制可以从两个层面来研究,一是事实层面,一是价值层面。价值层面的研究是以人和人的需求为依据展开分析,对分权制衡机制的正当性进行论证。刑事诉讼中的分权制衡机制之价值体现在四个方面:一是其作为刑事诉讼主体自由保障机制的价值;二是其作为诉讼公正实现机制的价值;三是其作为诉讼效益促生机制的价值;四是其作为对立关系缓释机制的价值。由此,我们不应当仅把刑事诉讼分权制衡机制视为权力制约的方式,而要全面认识其在刑事诉讼理论与实践中的重要意义,并在制度构建中充分贯彻和体现分权制衡原则,使该机制能更好地发挥功用。
