The Nature and Feature of Insurance Agent Agreement(IAA)

The legal nature of IAA is that it is an important part of agent agreement in civil law. It is a bilateral legal act, a bilateral contract (an onerous contract with statutory and conventional role), an unplanned contract, and a formal contract. Both parties involved in the agreement must be equal to each other and mutually benefited, and must act on the legal principles drawn up by the two sides. The legal features of IAA reflect themselves in the following three aspects: the special characteristics of the relationship of IAA (one internal relationship and two external ones); the special features of the mainstay of IAA (sensu lato and sensu stricto, specified as insurance agent limited company and personal agent); and the special features of the contents of IAA (the main rules of the written contract and the extent of the right for each of the three kinds of insurance agent have been specified by law).
