摘    要:作为一种市场营销方式,传销在我国具有极大的争议性。其出现后所经历的一系列发展变化过程,使得人们对传销的认识模糊不清。传销的特有形式和内容决定其在销售上具有传统销售方式不可比拟的优点,应当予以承认。从竞争法的角度而言,传销和变质传销都存在不正当竞争的问题。澄清对这一问题的错误认识,将有助于我国在这方面的正确立法。

Abstract:As a method of marketing,there are a lot of controversies about Multi-level Marketing in our country.We can't understand it correctly after its arrival and a series of changes subsequently.Author thinks that we should admit it because of its advantages in selling which are determined by its special form and content.From the attitude of Competitive Law,Multi-level Marketing and Multi-level Marketing deteriorated in quality both have the matters of unfair competition.It is helpful for our country's lawmaking correctly to clarify the misunderstanding on the matter.
