| 摘 要： | 在综合比较了中外人身损害赔偿制度的基础上,系统地提出了中国人身损害赔偿的改革方案:即以侵权法为基础,以其他救济措施为辅助,建立全面、和谐、易于操作的人身损害赔偿制度,最大限度地救济处于弱势地位的受害者。

| Abstract: | The essay mainly discusses the role of the tort compensation in personal injuries as well as the problems involved.Based on a comprehensive comparison of personal injuries compensation system both in home and abroad,the author proposes a plan of reform on Chinese personal injures compensation system,which takes the tort compensation as the core and other collateral benefits as the necessary substitutes in order to award as much as the damages to the victims. |
