第三代行政程序之比较研究

借鉴Barnes教授提出的第三代行政程序的理论模型，结合中国现实情况，对中国行政程序的发展状况进行了评估。首先探讨了中国是否已经具备了新行政法产生的条件，接着按照上述理论模型对中国现有的行政程序进行划分，最后结合特定领域来分析中国行政程序目前已经取得的成就和不足，论证了中国引入第三代行政程序的必要性。

A Comparative Study of the Third Generation Administrative Procedure

Based on the theoretical model of the third generation administrative procedure proposed by professor Barnes, this paper evaluates the development of administrative procedure in China. This paper first discusses whether China already has the conditions for the new administrative law, and then divides the existing administrative procedures according to the above theoretical model. Finally, this paper analyzes the achievements and shortcomings of China''s administrative procedure, and demonstrates the necessity of introducing the third generation administrative procedure.
