论民事执行权性质及执行机构设置

民事执行权在执行过程中是处于主导地位的基础性权力，它的本质属性直接决定了权力的机构设置。针对目前国内法学理论界对民事执行权性质的不同认识，运用比较的方法对民事执行权性质这一基础理论问题进行研究，认为民事执行权是司法权，并以此为依据设计合理的民事执行机构，旨在从根本上解决“执行难”问题。

Studies on the Civil Executive Power and the Executive Body

As one of the fundamental powers, the civil executive power in the course of implementa- tion is in a dominant position, which decides the institutional setting. Based on the different understanding of the power in the domestic theoretical circle of law, the paper discusses the basic theories comparatively. It is believed that since the civil executive power is the judicial power, the executive bodies thus established would solve the problem of ＂difficult implement＂.
