宏观调控法治化：价值、难题与实现

宏观调控法治化旨在规范、保障和控制宏观调控权的行使，是依法治国的题中之义。宏观调控法治化对提高宏观调控的绩效、降低宏观调控的风险、预防宏观调控沦为利益集团牟利的工具等均具有重要价值。但是，宏观调控法治化的实现，至少面临三大难题：观念难题、制度难题和技术难题。这些难题构成我国实现宏观调控法治化的环境。立足于这一环境，结合宏观调控相机抉择的特点，采取柔中带刚、从柔至刚和刚柔相济的方法，逐步实现宏观调控法治化。

Values,Challenges and Implementation of Legalization of Macro-control

Legalization of macro-control, the key to the rule of law, is designed to regulate, ensure and control the power of macro-control. Legalization of macro-control is of great values in improving the performance of macro-control, reducing the risk of macro-control, and preventing it from becoming a profit-making tool of the interest group, etc. But, there are at least three challenges, such as concept challenge, system challenge and technology challenge, in implementing the legalization of macro-control. These challenges constitute our environment of macro-control law. So, we should take methods which are combined with hardness and softness, according to discretion which is the characteristic of macro-control, based on the environment, to achieve the legalization of macro-control gradually.
