| 摘 要： | 人类的生存和发展离不开秩序,人类的文明进程也就是对秩序的追求过程。从伦理价值目标的主体需要性、至善性和刑罚的惩罚本质属性看,刑罚的伦理价值目标为体现个体自由和社会正义的社会秩序。这样的秩序是人类在长期的社会实践中自由选择的结果,是人类发展的需要。国家在实施制刑权、量刑权、行刑权时应该以这一目标为宗旨,不断实现公民自由,充分体现社会正义,维护和谐的社会秩序。
