完善我国社区矫正制度的思考

社区矫正反映了现代法治社会尊重人权的司法文明理念,是非监禁化的刑罚执行方式。刑罚执行从消极的监禁矫正逐渐演进到积极的社区矫正,是社区矫正本身功能作用的必然结果。我国的社区矫正存在着适用范围过窄、地区标准差异较大、主体职能划分不合理、缺乏专业社区矫正队伍以及社区发育程度较低等问题。因此,进一步发展和完善我国社区矫正制度对于逐步推进我国社区矫正立法尤为必要。
