| 摘 要： | 食盐问题是一个关系国计民生的问题，因此现行刑法将非法经营食盐行为规定为犯罪。但该罪的成立前提即食盐专营制度本身就不尽合理，而规定该罪的主要目的又在于保护公民身体健康而非维护市场秩序，因此，为遵循市场经济自由竞争的客观规律，顺应社会主义市场经济的发展，刑法关系也应做出相应调整，即应对非法经营食盐行为作非犯罪化处理。

| Abstract: | Salt is so important that our country established the salt monopoly system. Under this system, sah-oper- ating without a license is regarded as a this crime is for the people＇s health but clime. not to But the salt monopoly system is not rational and the legislation aim of maintain the market order. Therefore, the criminal law should not still take salt-operating without a license as a crime in order to follow the rules of free competition in market economy and promote the development of socialist market economy |
