论我国行政立法的监控

任何公共权力都必须受到监督和制约,行政立法权也不例外。自改革开放以来,我国行政立法得到迅猛发展,但是行政立法监控制度却比较薄弱,这种状况威胁或危害着我国民主政体和公民的权利和自由,影响着立法质量。为了兴利除弊,需要限制行政立法的范围、规范行政立法的程序、强化由人大监控、司法审查和行政监督、明确立法责任

On Legal Supervision and Control of Administrative Legislation in China

Any kinds of public power must be supervised and checked,and the legislative power of the administration is no exception.China's administrative legislation has developed very fast since the adoption of the reform and opening-up policy,but the supervision and control institutions of the administrative legislation have been deficient.Such conditions have threatened or harmed the democratic system,infringed the rights and freedom of the citizens,and affected the quality of the legislations.To promote the beneficial and abolish the harmful,the reform must be carried out to clarify the power and limit of the administrative legislation,specify the administrative procedure,strengthen the supervision and control of NPC,judicial review and administrative review,and clarify the legislative liabilities.
