法社会学视角下的刑讯逼供

法治社会下的刑讯逼供无疑是对法治的公然挑衅，如果单纯地将它看作是一个法律问题，从法学视角来认识，那么它是一种滥用职权、对人权的践踏以及无视法律存在的违法犯罪行为。与此同时，该问题也是一个社会问题，如果我们转换一下视角，用法社会学的视角来看刑讯逼供现象，我们会发现刑讯逼供是一种执法人员在社会变迁中以及社会分层后，由于执法过程中角色的突变使其在各种价值取舍之际所枉顾法律束缚的越轨行为。

Extorting a confession by torture in a society ruled by law is avowedly defiant to the rule of law.In terms of law,it is a crime of authority misusing or infringement upon human rights.From the perspective of sociology of law,it is a kind of deviance of law enforcement officers without awareness of lawful restriction when taking or rejecting different values because their roles have suddenly changed in the process of law-enforcement after the change and stratification of society.
