宪法学的实证研究方法初论——拓展我国宪法学研究空间的一个选择

本文认为，为拓展我国宪法学研究空间，实证地研究我国宪法是一个选择。本文分析了目前我国宪法学界存在的重构宪法学理论体系的现象，认为无论在其自身体系的建立还是其对我国宪法学现有体系的批评都是不能成立的。本文以我国宪法的社会主义初级阶段性质为依据，提出我国宪法学界目前的重心应是关注、阐释、指导我国的宪法实践。

To Study China's Constitution Positively

With his knowing respect to studies on constitution in China, the researcher supposes a new method, named method of positivism, which probably is not a new one in other countries. The researcher hopes scholars all around the world can know, and then comprehend China's Constitution, after they have read such positive constitutional writings of Chinese scholars.
