| 摘 要： | 经典社会理论讨论社会秩序的舞台是由工具主义理论与合法性理论两种思想传统之间的斗争建立的，对法的社会基础问题的思考是从对社会秩序问题的思考开始的。讨论两种理论进路，综合阐述合法性思路在法的社会基础上的运用，并结合中国国情提出巩固法的社会基础的一些建议。

| Abstract: | The stage of discussing about the social order by classic society theory has been built since the fighting between the two traditional thoughts,i.e.instrumentalism theory and legitimacy theory.The thinking on the problem of social base of law initiated from the thinking on the problem of social order.The paper discussed these two kinds of theory,set forth thought of legitimacy applying to the social base of law synthetically,and put forward some suggestion of consolidating the social base of law combining with our country reality. |
