| 摘 要： | 司法审判并不是一个机械地适用法律规范的过程，而是一个包含了众多微妙复杂的判断之过程，这在疑难案件的审判中尤为凸显。法官作为法律帝国中的王公贵族有时候也会遇到措手不及的问题，为了公正有效地审理案件、解决纠纷，法官就不得不求助于其他的一些法律智识力量，而专家的论证意见就是其基本的表现形式之一。

| Abstract: | The administration of justice is not a course in which the legal norm is applied logically, but one including numerous delicate and complicated judgements, which becomes more obvious in hard case. Judges meet with the questions of making no adequate defense sometimes. In order to judge a case and solve the dispute effectively and fairly, judges have to resort to some other legal knowledge, among which is the suggestion from the expert. |
