林权与地志:云南新村个案

文章讨论的内容属于森林"产权"的范围.但是这里将不从国家法的产权定义开始.相反,从一个村庄的生活世界之地志特征(topographic features)出发.基于民族志调查的材料,文章表明:一方面"村规民约"支配着地方的林权制度模式,另一方面也影响基层对国家政策规范的读解.在描述了这些与历史和社会空间相联系的地方"法"的生成以后,文章提出研究必须以直面传统与现代性相互"共度"的主动思路来理解中国的社会变迁和国家治理,以及建构社会理论.

The Forestry Tenure and the Topography : A Case Study of a Yunnan Vil lage
