| 摘 要： | 直诉制度是我国古代一项特殊的诉讼制度。它不仅在一定程度上弥补了中国古代常规诉讼制度的不足,而且对国家官员的司法腐败具有一定的监督和纠察作用。更重要的是,它是中国古代民众洗脱冤情,诉求正义的一种重要途径。在法理上对它进行分析,有利于人们透析其存在的法学基础,明晰其运行的法学机理,进而探究其在当代进化和重生的可能性。

| Abstract: | Straight sues system is a special litigation system in ancient China.It not only compensates for the insufficiency of the ancient Chinese conventional litigation system to some extent,but also has certain supervision and pickets role in national official judicial corruption.More importantly,it is an important way for the Chinese ancient people to call for justice.Jurisprudential analysis on it is helpful for people to dialyze its existing legal basis,clarify their run of legal mechanism,and then explore the contemporary evolution and rebirth possibility. |
