国际法宪政问题研究

尽管国际社会的相互依存局面导致了国际法的宪政化，许多国际法学者仍然对其深表怀疑和否定。本文从语义学角度解析constitution的内涵，确认宪政的本质内涵就是法律规则的体系化，进而确认了国际宪政的可能性。在此基础上，从国际强行法视角对国际法的宪政内涵进行分析，并且对国际宪政和国家宪政之间的关系进行了论述。

On the Constitutionalization of International Law

Although the interdependence of international community has led to the constitutionalization of international law, many international law scholars still doubt and negate the possibility of international constitutional law. This article analyses the connotation of ＂constitution＂ in terms of semantics, and then confirms the essence of constitutional law being systemization of law regulations, and further confirms the possi- bility of international constitution. Based upon the above analysis, this article has done researches on the connotation of international constitutionalization in the perspective of international jus cogens, and has also discussed the relationship between international constitutionalization and national constitutionalization.
