| 摘 要： | 农村宅基地使用权兼具物权性与社会保障性，我国未来的农村宅基地使用权应当向强化物权性，弱化社会保障性的方向发展，重构物权。农村宅基地使用权物权重构的前提是建立农村社会保障制度。农村宅基地使用权的物权重构主要包括：重构农村宅基地使用权的权利内容；重构农村宅基地使用权取得与消灭制度；重构农村宅基地使用权流转制度。

| Abstract: | The right to use of house site in rural areas possesses both characteristics of the property right and social insurance.In the future our efforts should be made in regard to the right to use of house site to strengthen the characteristic of the property right and to weaken its social insurance feature and reconstruct the property right in the rural areas.The prerequisite of reconstructing the property right to use of house site is to establish the social insurance system in rural areas.The reconstruction of the property right to use of house site in the rural areas includes: the reconstruction of the content of the right to use of house site;the reconstruction of the system of acquisition and elimination of the right to use of house site;the reconstruction of the system of turnover of the right to use of house site. |
