论社会利益及其法律调控--对经济法基础的再认识

我们要获得对经济法规范的理性认识 ,必须首先深入认识经济法规范形式背后的利益性质和形式 ,因为任何一个法律部门的出现都是利益发生冲突的结果。其次必须深入研究调整这种利益关系的国家权力的运行方式。本文正是从这两个方面展开 ,一是通过对社会利益的独立及其特征的论述阐明了经济法产生的根本原因和经济法存在的完全充足理由。二是从国家权力运行方式的角度对经济法性质进行了再思考——经济法既是政府干预之法更是干预政府之法。同时 ,根据法律实质论和法律形式论的理解 ,解释了在经济法领域出现的“私法公法化”和“公法私法化”的现象

Study on Benefit of Society and Regulation by Law--Further knowledge on the foundation of economic law

In order to gain the rational knowledge of economic law, first, we must understand the nature and the form of the benefits behind the normal form of the economic law, because the appearance of any law department is the result of benefit conflict. Second, we must deeply research the operation mode of the state power that regulates such beneficial relations. In this paper, we start from these two respects to specify the reason why the economic laws grow by virtue of discussing the independence of economic laws and their feature; next, to again reflect on the nature of economic laws from the angle of the operation mode of the state, i.e. economic laws are that intervened in by the government as well as that intervene in the government. Meanwhile, according to the comprehension of the essence and the form of the law, explain the phenomenon that in the economic law field there happen "the integration of private law and public law".
