| 摘 要： | 我国食品消费维权在举证责任层面上存在举证食品来源难、举证食品缺陷难和举证因果关系难三重困境,这三重困境导致我国食品消费维权举步维艰.未来的司法实务应利用公平原则解决食品来源举证问题,适用责任倒置机制解决食品缺陷举证问题,采用盖然性标准解决因果关系举证问题.

| Abstract: | As a response to the spirit of China＇s Constitution, ＂the nation respecting and protecting human rights＂, China＇s new Criminal Procedure Law has made a great improvement in its compulsory measures. However, there still remain many unsatisfactory in the non-detention compulsory measures and deep problems unsolved. With a study on Russia＇s practice, the paper hopes to make some helpful findings in constructing a more scientific and reasonable system of non-detention compulsory measures that may improve the applicable conditions of criminal compulsory measures as well as further protect human rights and safeguard lawful rights and in- terests of our citizens. |
