民初合伙合同法律规则形成略考

民初,现代合伙合同的成立规则经由北京政府时期的大理院判例【4年上字第244号】及其他辅助判例初步建立,由此成为这一领域的立法及学术脉络起源。但长期以来,受制于大理院判例编纂中的编年体限制,本部内容全貌及其过程始终无法得到突出反映,故拟以此文攫取有关判例,就其概况及其相对于实践所体现出的不足等层面予以详述。

Development of Association Contract in the Early Republic of China

With the absence of legislation,the regulation for the formation of association contract was evolved through a series of precedents of the Supreme Court,at the early stage of the Republic of China.However,the process of evolvement of this specific field was concealed by the collection of all cases concerning the law of association,which was edited in a chronicle way.The paper attempts to pick out those precedents that concern the formation of association contract,and expound their evolution and deficiency.
