| 摘 要： | 外国有关国家对未注册商标的保护措施比较完善,立法也较早,能够较好适应社会经济发展,维护公平竞争; 而我国的旧《商标法》对未注册商标保护的依据基本欠缺,屡次出现恶意抢注而损害在先使用人的权利,尽管修改 后的新《商标法》加强了对未注册商标的保护,但与外国的立法相比还有诸多不尽人意之处。

| Abstract: | Some foreign countries are perfect measures taken to protect the unregistered trademakes,with legislation, thus it is good to adjust to social economic development, and to maintain competition equally while old Chinese Trademark law has defects on protection for unregistered trademarks,and the previous userss rights often are damaged, though revised trademark law has reinforced protection for unregistered trademarks, it is not satisfatory in comparison with foreign legislation. |
