| 摘 要： | 绿色贸易壁垒是一种新型的市场准入制度,它表现为多种形式,其法律依据是WTO的一些例外条款。以进口国实施它的动机为标准,可分为正当和不正当的绿色贸易壁垒。合理地利用绿色贸易壁垒手段来保护生态环境是WTO规则所认可的,但反对不正当的利用绿色贸易壁垒。我国应在国际贸易中合理利用绿色贸易壁垒来保护我国的生态环境,抵制和反击发达国家针对我国采取的不正当的绿色贸易壁垒。

| Abstract: | Green trade barrier,which has many different forms,with some exceptional provisions of WTO as its legal basis,is a new type of market accession system.According to the motive of the country that implements it,it can be divided into normal green trade barrier and abnormal green trade barrier.It is permitted by the WTOs regulations to reasonably use green trade barrier to protect ecology,but unreasonable use of it is objected.China should reasonably use green trade barrier to protect the ecology in international trading,thus to boycott and counterattack the abnormal green trade barrier from some developed countries. |
