| 摘 要： | 情事变更原则以其独有的价值取向适应了变化中的经济关系的需要,而在实践中适用的难点在于易与不可抗力、商业风险相混淆,三者的区别集中于事实构成要件方面、主观预见性方面及对合同基础的预见性方面.情事变更原则对我国在建立社会主义市场经济过程中所产生的各种利益矛盾的解决有独特作用.

| Abstract: | Change of circumstance satisfies the need of continuously changing economic relations in its specific value judgement.When being applied in reality,it is easily confused with force of nonresistance?Commercial risks.The differences between them focus on three points:factual constitution,subjective predictability,and the influence on the contractual basis.Meanwhile, it will have special effect in dealing with conflict of various interests that we meet in establishing Social Market Economical system. |
