论文化与犯罪的起源

文化与犯罪都起源于原始社会,说明从历史渊源上,文化与犯罪是不可分的。如果说,在文明社会犯罪在本质上是向兽性的复归,那么在原始社会,犯罪就是人类兽性的随意表露。因此,原始社会的犯罪必然更司空见惯,更被认为是社会的正常现象。由犯罪起源可知,从本源上讲,犯罪与私有制和阶级斗争没有直接的关系。私有制和阶级斗争能增加一些新的犯罪类型,能加剧某些犯罪,但不能决定犯罪的起源。

The Origin of Culture and Crimes

Culture and crimes can both be traced back to primitive society, indicating that they share the same historical origin. If committing crimes in civilized society is return to brutality, then that in primitive society is the spontaneous display of the animal side of human beings. Therefore, crimes are seen as the norm rather than the deviation in primitive society. The origin of crimes shows that crimes are not directly related to private ownership and class struggle, which may increase or exacerbate some types of crimes, but which cannot determine the origin of crimes.
