法治视野下行政体制改革探索

法治作为一个历史概念，既具有普适性，又具有地方性。对源自西方的法治概念作中国情势解读，它在组成形态上包含私法之治、私法的公法之治、公法之治三部分。法治视野下的行政体制改革的使命，实质上就是要在行政领域实现行政法治；作为互动的另一面，行政体制改革应当从观念变革和法律制度完善两个方面对法治作出回应。

Research on Administrative System Reform from the View of Rule of Law

As a historical concept, the rule of law has the universal and endemic attribute. From the Chinese perspective, the western concept of the rule of law includes rule of private law, public rule by private law, and rule of public law. Form the view of the rule of law, the mission of administrative system reform executes the rule of administrative law. As the other side of interaction, the administrative system reform should he responsive to the rule of law from the change of ideology and the improvement of legal system.
