| 摘 要： | 知识产权权利限制制度的创设旨在使权利人与社会大众之间保持一种利益上的平衡关系。基于同一目的,也有必要对知识产权的权利限制予以限制。选择权利限制时应当考虑社会经济发展水平、科技发展水平和权利限制引发的成本。

| Abstract: | Establishing a system of limiting the power of the intellectual property rights aims to balance the relationship between the right holders and the general public.There is a need for restricting the limitation of the power of the intellectual property rights so as to achieve the same goal.The paper holds that socio-economic status,technological development and possible expenses incurred by restricting power should be taken into consideration when the power is limited. |
