论我国不可量物侵害救济制度之完善

我国可以规制不可量物侵害救济的现行法律仅有《物权法》第90条、《民法通则》中侵权行为条文和《环境保护法》中不可量物环境污染条文,但这些规定并不能为不可量物侵害中的受害人提供合理而及时的救济。我国应从不可量物侵害的概念、不可量物侵害的构成要件、不可量物侵害的类型及不可量物侵害的救济方式等方面完善现行的不可量物侵害救济制度,以利于不可量物侵害纠纷案件的解决。

On the comsummation of the system of relief against immeasurable object's invasion

In China,the laws that can be used to regulate the immeasurable object′s invasion mainly include for " Property Law " in paragraph 90,the provisions in "General Principles of Civil Law",and the violations as well as the "Environmental Protection Law" in the regulation of environmental pollution for immeasurable object′s invasion.But these provisions are not sufficient for victims of immeasurable object′s invasion to provide the perfect and reasonable protection.In order to promote the settlement of the cases of immeasurable object′s invasion,it is necessary to comsummate the current system of immeasurable object′s invasion from the aspects of the conception of the immeasurable object′s invasion,constitutive requirements of the immeasurable object′s invasion,type of the immeasurable object′s invasion and remedy of the immeasurable object′s invasion.
