| 摘 要： | 刑罚正当性根据是整个刑罚理论的基础,直到目前最有影响的有三种学说:报应正当论、预防正当论和报应与预防一体论。本文在评析传统理论的基础上,提出了创新的观点:科学的刑罚正当性根据应坚持以间接一般预防为中心,兼顾报应与特殊预防的要求,即在间接一般预防基础上的报应与特殊预防的有机统一。这一观点可以为我国刑事政策的调整提供理论依据。

| Abstract: | The punishment legitimate foundation is the basis of the whole punishment theory.Till now,for this,there are three most effective theories: 1.retribution being just theory;2.prevention being just theory;3 combining the above two into integration theory.In this note,the author puts forth an innovation viewpoint: For the scientific punishment legitimate nature,it is necessary to adhere to taking general indirect prevention as the center;concurrently to consider the need of retribution and special prevention;i.e.on the basis of indirect general prevention,organically unite retribution with special prevention.This viewpoint may provide the theoretic foundation for our country's criminal policy. |
