论我国民族自治地方立法的几个问题

本文探讨了有关我国民族自治地方立法的五个重要问题,即民族自治地方立法的涵义、民族自治地方立法的性质、民族自治地方立法的法律地位、自治法规制定主体的系属、民族自治地方立法的重点选择。在此基础上着重指出,民族自治地方立法是民族自治地方的权力机关和行政机关具体行使国家立法权的一种治国活动;民族自治地方立法是原创立法与地方立法、一般立法与特殊立法的统一;民族自治地方立法只能在本辖区内有效;赋予民族自治地方的人大常委会以自治法规的制定权,实行经济立法和文化立法并重,既是民族自治地方完善立法体制的需要,也是民族自治地方适应全面建设小康和谐社会的需要。

On the Problems of Legislation in Autonomous Regions of Ethnic Minorities

This paper mainly deals with 5 important problems concerning the legislation of autonomous regions of ethnic minorities: meanings,nature,legal position,a key choice of autonomous regions of ethnic minorities and principle systems of autonomous laws and regulations.On the basis of these points,the paper points out that the legislation of minority-autonomous regions is a special activity on governing a country.It is not only localized and initiative,but also generalized and specialized.It can only be effective within its own area. The fact that the Standing Committees of People's Representative Congress of minority-autonomous regions are authorized to make autonomous laws and that we should pay more attention to the cultural legislation,are necessary to improve the legislative system and the construction of a rich-harmonious society.
