| 摘 要： | 现行国家赔偿法设立的赔偿程序,既不是审判程序也不是行政程序,而是一个介于两者之间的独特程序。这个程序在设计时因为过多的考虑了简便、快捷和容易操作的一面,因此导致国家赔偿程序设立的确认程序、申诉程序、审理程序和执行程序与人权保障发生极大的冲突,其结果不仅破坏了公平、正义的法律精神,更重要的是使人权保障受到严重损害。

| Abstract: | The present procedure of compensation is neither the administrative one nor the judicial process.It is a special procedure between these two ones.It is simple, quick and easy to operate.However, it arouses the the conflicts between procedure of compensation and safeguarding of human rights. Consequently, it results in injustice in law and badly damage of human rights. |
