| 摘 要： | 民事诉讼受案范围是民事诉讼理论和实践中的一个重大问题。探讨该问题,对于完善现行立法、指导司法实践及促进民诉基本理论问题的研究都有不容忽视的意义与价值。针对目前法院民事受案范围中存在的诸多问题,本文着重论述了确定法院民事受案范围时应考虑的相关因素及应遵循的原则、标准,并提出了一些完善现行立法的建议。

In view of the existied problems in theory, legislation and judicial practice, the author puts forward some factors and rules which should be considered when determining the competence of civil cases and some suggestions concerning on redefining the competence of civil cases |
