司法裁判吸纳民意机制之建构

司法裁判领域中的民意存在的问题有：民意表达欠缺合理性基础、正当的民意表达与不当干预并存、法院对如何处理民意没有法律上的依据。有必要建构一个司法裁判吸纳民意的机制，从民意书的主体及表达方式、民意书的提交与公开、法院对民意的回应等方面规范民意对司法裁判的影响，尽可能多地在司法裁判中吸纳合理的民意成分，确保司法裁判能够实现最大限度的社会公正。

On the Establishment of the System of Accepting Public Opinions in Judicial Judgment

Public opinions may be irrational, and even coexist with improper intervention. It is held that a system that accepts public opinions in judicial judgment should be established so as to regulate how pubic opinions can be expressed and courts can respond to them for the sake of maximal justice.
