“华化”与土俗之争背景下高丽对宋代法制的移植

高丽移植宋代法制的进程较为曲折，首先就存在法律移植与本土资源关系的问题，因“华化”与土俗的冲突，高丽王权对宋代法制的移植难以得到贵族精英阶层的支持，不得不启用大量的归化中国士人。与此同时，作为法制输出国的宋王朝又实行严格的图书管制措施，使得高丽对宋代法制的移植缺乏可靠的参照文本，使其对宋制的移植缺乏系统性。

On the Law Transplanting of Koryo Dynasty to Song Dynasty

It was a tortuous process that Koryo dynasty transplanted the legal system of Song dynasty.Firstly,it was difficult to deal the relationship between the native resource of the Koryo dynasty and the transplanting of the legal system of Song.Because of the debate between the policy of "huahua" and the opinion of keeping to local habits and customs in Koryo dynasty,The king had much difficult to get the support of aristocratic elite,the king had to appoin the Chinese talent.At the same time,as the exporter of legal system,Song dynasty had strict measures to control the book exporting,so that Koryo dynasty had not the reliable reference text when it transplanted the legal system of Song Dynasty.So such transplanting was lack of systematic.
