| 摘 要： | 国际社会基于“技术中立”及“功能等同”原则就在线仲裁对《纽约公约》的扩大释义正逐渐形成统一的国际司法解释，各内国法也必定在博弈后与之相应调和，届时，《纽约公约》界定的诸条件将不会再对在线仲裁的承认与执行构成实质性障碍。这一过程的快慢与网络通讯技术的发展程度及各国对仲裁的电子化、国际化需求程度息息相关。在线仲裁有效纳入《纽约公约》的运行体系是其存续、完善和发展的必由之路。
