通过对都市乡村进行调查,揭示了在都市乡村的社会场景中,乡土社会形成的传统礼俗与现代法律制度,经过不断地融通,最终提供了各种既非礼俗又非西方既有法律的制度,满足了社群主体在社会生活中不断变化的生活需求;说明在中国的社会结构中,乡土社会形成的地方性知识与政府推进型知识的相互改造、融合,形成各种满足人们社会生活需求的法律制度。

A Way to the Construction of the Legal System in the Mobile Society Structure

Through an outdoor investigation in urban and rural areas, it has been revealed that in the social scene of urban and rural areas, the traditional customs formed in the rural society, which are undergoing consecutive exchanges and blending, have provided finally varied systems that are neither rites and customs nor existent western laws resulting in satisfying the changing life demands of the community groups in the social life. This shows that in the mobile social structure in China, the local knowledge formed in the rural society and the knowledge promoted by the government are subjected to mutual transformation, and blending thus forming various legal systems meeting the demands of social life of the people.
