对《侵权责任法》中医师告知义务的立法建议

告知义务是医师的法定义务。在医疗损害民事赔偿案件中,判断医方是否违反医师告知义务以及是否承担责任的依据,是2010年7月1日起实施的《侵权责任法》关于医师告知义务的规定。但该规定存在某些基本概念缺乏确切的定义、对告知的范围缺乏具体规定等问题,在实践中将产生诸多问题。针对这些问题进行分析,提出相关的立法完善建议。
