实践法理学与环境法学的新视角

实践法理学把法视为实践的智慧,从主体间性的哲学立场上把行动中的法看做是规范与事实相互关照的连续性结果和具有说服力的意见。从实践法理学的角度出发,环境法学的中国问题应该是政府失灵。环境法的哲学基础是主体间性范式下的生态体认观。环境法治的等置实践就在于认识社会事实与环境法规范的对立,推动政府环境信息公开和培育社会的环保理念。
