| 摘 要： | 文章对市场经济与物权法的关系作了较好的分析 ,特别对日本担保物权法的创立和发展作了详细介绍。在此基础上 ,从不同角度对新物权法理论进行了展望 ,提出了许多很有参考价值的理论观点。
