| 摘 要： | 列举《周礼》中所见的军事法规与相关刑罚,计有军旅、田猎迟到罪,不从将命罪,干犯军阵罪,不关罪和采邑征兵不及罪五条军法条文,以及一些没有明确罪名的军事法规。提出《周礼》中的军法、军刑与当时军队＂寓兵于农＂的建军模式相适应,还处在习惯法的发展阶段,有着简略性、临时性的特点,但也具备了某些成文法的特征。

| Abstract: | Five penalty-related articles from the military statutes in Chou Rituals are enumerated,including crimes of late operation or hunting,violation of order,damage to battle formation,intentional failure in report to a senior officer,and failure of a manor owner in draft.It is pointed out that the military rules and penalties in Chou Rituals were suited to the historical characteristic that soldiers worked as farmers in time of peace and acted as fighters in case of war,and still at the development stage of cus... |
